As for the European court opinion on what should or should not have been on the list, I confess that I think that gives up the game just to consider it. On that score, I think that a menu item list is not the way to go, for the reasons Ignatieff has already outlined, namely, that it suggests that people will do 'whatever is on the list' rather than exercise professional judgment about the minimum that is required. In short, "a list" removes incentives to avoid a 'big inquiry' (or even a lawsuit) by doing just what is reasonable and no more.
