The Classified War
Right of private action being fought out now on wire-taps secrecy: one of the last ways to inject accountability and balance into the Secret War to Come ?
One has to wonder if this Congress isn't still just feeling their way through the difficult issues without a clear direction or strategy for coping.
'Secret programs' cannot go without oversight (witness project "Able Danger") and ought to stand the test of effectiveness, but not by the Unitary Executive who runs them.
What's more, steps to inject accountability / culpability help prevent "rogue" adventures in information collection - from that perspective, "indemnity" is not desirable. People probably should worry about whether their actions are honestly defensible, not just "covered".
How else do your force "findings" to be at least minimally substantive?
