You come up with your own legal theory about the Powers of the President, either as a signing statement or otherwise (you know, Yoo-who and yahoo ...).

Then, rather than face up to the legal consequences of such unilateral course, namely that you could be found wrong, you destroy the evidence ... Carefully, to avoid trampling records keeping laws ...

Just another piece in the puzzle of why Zubaydah was prosecuted when he was, maybe ... and others have yet to have any action whatsoever, it seems (I don't keep track of the numbers, but can sense that the whole issue of when/how to prosecute those being held is set to get dumped on the next Executive, mostly).
